If you do not agree with these Terms, then you must cease use of this Website immediately. These Terms are a contract between us and you & you may wish to print a copy for future reference. For the avoidance of doubt, please note that each time you access this Website (for whatever reason), you will be deemed to have accepted these Terms.
We may revise these Terms at any time by updating this posting. You should therefore check this Website from time to time to review the then current Terms to ensure that you are at all times fully aware of our current Terms. Any changes are effective immediately upon posting to the Website.

3. DESCRIPTION OF GOODS
3.1 We take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at the time when the relevant information was entered onto the system. However, although we aim to keep the Website as up to date as possible, we do not warrant that product descriptions, colours or other content available on the Website are accurate, complete, reliable, current, or error-free. We try to include as much information as we feel necessary for you to make an informed choice. The colours on your screen and any product descriptions should be used as a guide only.
3.2 In addition, due to the fact that the products are made of natural ingredients and components, slight variations may occur in actual Goods. All dimensions are approximate.
4. SECURITY
4.1 We have taken steps to ensure the security and privacy of our systems and our user’s data and personal information. Our Website uses a secure payment system – PayPal as its payment gateway & merchant facility. The Bearfoot payment processing system uses SSL (Secure Sockets Layer) technology – the industry standard for encryption technology. SSL is the system that is used by all reputable e-commerce sites. SSL technology is compatible with most browsers. SSL encrypts all information (e.g. your credit card number) passed from your browser to our payment gateway, making it almost impossible to be intercepted by an unauthorised party, as long as your browser and local network supports the use of encrypted data transmissions. You can identify that you are on a secure site when the padlock appears at the bottom of the screen.
4.2 All card details are encrypted using 168-bit encryption; they are not held in clear text on any website. When you choose to pay online, your card details will not be available to Bearfoot staff. During payment you are transferred to PayPal’s secure site where you will enter your card details. We do not have access to these details at any time. Your card and address details are security checked and verified with the relevant card issuer and your payment is pre-authorised. You will receive a message in your internet browser window to tell you that payment has been authorised, and we will receive confirmation from the payment provider.
4.3 Customer Details Separate from Card Details
Customer details will be stored by Bearfoot separately from card details which are entered by the client on the PayPal secure site. For more detail on PayPal & it’s security systems refer to PayPal’s website
5. PAYMENT
5.1 Payment of the price of an order must be received by us and cleared before despatch of your Goods.
5.2 We accept MasterCard, Visa & PayPal for online payment. The merchant outlet country at the time of presenting payment options to the cardholder is Australia. All transactions are in Australian Dollars ($). If paying by credit or debit card, please advise us of the billing address your provider holds on file. You confirm that the credit or debit card that is being used is yours. We cannot be liable for any unauthorised transactions nor can we be held liable for any denied payments which are a result of the information provided by you.
5.3 All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to, or subsequently refuses to, or does not, for any reason, authorise payment to us, we will contact the card holder to advise. However, we shall not be responsible for any costs or inconvenience caused by a subsequent delay, denial or payment or subsequent non-delivery of any Goods on the basis of the above.
5.4 If you would prefer not to send your credit or debit card details over the internet, you are still able to choose to pay by direct deposit. At checkout you simply choose your preferred payment option i.e Direct Deposit & the banking details will be given to you.
6. EXPORT RESTRICTION
The offering on this website is available to Australian clients only.
7. DESPATCH
7.1 Every effort is made to ensure that your order is despatched within 1-2 working day of order & payment has been received by Bearfoot, subject to events that are beyond our reasonable control.
7.2 If your ordered item is unexpectedly out of stock we will contact you to offer an alternative, and if we cannot contact you, or you so wish, we will give you a refund for that out of stock item.
8. DELIVERY

9. REFUNDS
9.1 Refunds for orders made will be considered on a case by case basis.
You will need to contact Bearfoot up to 7 days after the date of delivery in order to request a refund.
Please note that we will not be in a position to address your problem where you have been careless or unreasonable in your demands.
Note: BEARFOOT is not required to provide you with a refund if you have simply changed your mind or you find a similar or the same item at a cheaper price elsewhere.
9.2 To request a refund
In order to get authorization for return you must contact the Bearfoot Office in writing at info.bearfoot@gmail.com, within 7 days after the date of delivery.
We will then evaluate your refund & if applicable issue you with a Return Merchandise Authorization Number (RMA#) before returning the product. Returns without RMA#’s will be refused.
Please return the Goods, unused and in their original packaging together with a copy of the invoice.
Please note that, for reasons of hygiene, we are unable to offer refunds or exchanges on any opened or used product.
9.3 We will not accept any responsibility for loss or damage to Goods returned in this way until they are received at our above address. We strongly recommend that returns are sent by ‘insured registered delivery’ and the original proof of posting is kept. Please note that we are not responsible for return postage other than for incorrectly supplied, defective or damaged Goods. Return postage for Goods returned for any other reason shall be solely at your cost.
9.4 Once we receive the Goods in their original condition, any payments made by you for your purchase will be refunded in full within 10 working days or, where applicable, replacement Goods will be despatched to you as soon as possible with no further costs for you.
9.5 If an incorrect product has been sent by us, please contact us within 7 days of receiving the order, (sending an email will be the quickest) and we will resolve the issue as quickly as possible. You will get a credit from us, or a replacement item that will be sent to you immediately at no extra charge.
10. CANCELLATION OF ORDERS
10.1 If you make a mistake or need to amend or cancel an order, please contact us immediately on 0406 717 234 or email us at info.bearfoot@gmail.com
Pursuant to these Terms of Use, if you need to cancel your order, at our discretion money can be refunded less a $10 administrative fee, ONLY IF notice is received by BEARFOOT 24 hours after the order is placed.
You will receive an email confirmation once your order cancellation has been processed.
11. DAMAGED GOODS
11.1 You should inspect the Goods when you receive them for damage or defects. In the event that your order is incorrectly shipped or found to be damaged or defective, please contact us within 2 working days of receipt of Goods. The Goods should be promptly sent back to us including the original invoice and packaging. We will then offer you a full refund or replacement including postage.
12. GOVERNING LAW
12.1 This Website and these Terms are governed by and construed in accordance with English law. You hereby agree unequivocally that any disputes arising in connection with this Website or these Terms shall be subject to the exclusive jurisdiction of the English courts without exception.
13. COPYRIGHT NOTICE
13.1 All content on the Bearfoot website, including, for example, all images, illustrations, graphics, design and text, are subject to trademark, copyright and/or other intellectual property rights or licenses held by Bearfoot, one of its affiliates or by third parties who have licensed their materials to Bearfoot. Any use of materials on this site, including (but not limited to) reproduction for purposes other than those noted on our site, transmission, modification, display, distribution or republication, without the prior written permission from Bearfoot is strictly prohibited. Users are not permitted to use web crawlers or other types of software or hardware technology to automatically download large amounts of materials from the Bearfoot site. No part of this site may be imitated in whole or in part on other web sites.
